The Probate Process

Probate is the name given to the process that appoints someone to deal with the estate of the deceased. If the deceased made a Will, then the person named as ‘Executor’ in the Will is granted Probate. Otherwise, somebody (usually the deceased’s closest relative) has to apply to the Probate Registry for the right to administer the estate. In both cases this person does the same job of dealing with the estate. This involves things like: collecting all the assets, paying off any debts and funeral expenses, dealing with legal and administrative formalities regarding the death, and distributing any remaining assets.

The Grant of Probate will allow the Executor or Administrator to deal with the Banks, Local Authorities, Pension and Insurance companies and other relevant authorities dealing with selling off any assets.
