Pre-nuptial Agreements

A Pre-nuptial agreement is a formal contract which is drawn up before marriage, in which couples set out how their assets will be shared (or otherwise) if they separate or divorce. Pre-nuptial agreements are not currently binding in English law however, they can be taken into account by the courts if there is a dispute during the course of the divorce. In fact, recent case law suggests that judges do tend to give them considerable weight, if they are carefully drawn up and signed. If circumstances change, and both partners agree, the terms of prenuptial agreements can be changed over the course of the marriage.

Nobody plans to get divorced, so these kinds of arrangements may not seem appealing or necessary in the time leading up to your wedding. However, it is sensible to make sure that your interests and those of your children are protected in case things don’t work out. Contrary to popular belief, prenuptial agreements are not just for the super-rich, demand for them is growing and the contracts are becoming more popular with younger professionals.

Dale & Co.’s family law solicitors can help you draft an agreement that has a strong chance of being upheld in court. We can also advise as to whether an agreement which is already drawn-up is reasonable, fair, or sound. Contact Dale & Co. today for free, impartial advice.
